The Massachusetts Pay Transparency Law is intended to increase equity and transparency in pay in the Commonwealth. Generally, the law requires covered employers to post pay ranges for open positions, as well as provide pay ranges when employees are being transferred or promoted to certain positions, and in some cases upon request. These requirements go into effect on October 29, 2025.
What Does the Law Require?
MIT, along with other covered employers, is required to:
- Include the pay range in all job postings, regardless of where the job is posted;
- Job posting is defined as “any advertisement or job posting intended to recruit job applicants, including, but not limited to, recruitment done directly by a covered employer or indirectly through a third party.”
- Provide the pay range to a current employee who is offered a promotion or transfer to a new position; and
- Provide the pay range to an employee, or to an applicant for the position, upon request.
A pay range is the annual salary range or hourly wage range that MIT reasonably and in good faith expects to pay for such a position at that time. See MIT Pay Grade Ranges and FAQs (Touchstone required) for more information.
What Should I Do in Response to the New Requirements?
Effective October 29, 2025, we are required to do the following:
As a recruiter or hiring manager
- Ensure all job postings have the appropriate pay range, regardless of posting or advertising site.
As an HR administrator
- Ensure all job postings have the appropriate pay range, regardless of posting or advertising site.
- Provide the appropriate pay range to an employee for their own position, upon request, or to managers for employee requests.
- Provide the pay range for the new job in the promotion or transfer letter to the employee.
As a manager or supervisor
- Familiarize yourself with the process for obtaining pay ranges in your School/Area and DLCI. If you have any questions about this process, please contact your local HR administrator.
- Provide the job's pay range to an employee if they are being promoted or transferred to a new job with different responsibilities.
- Provide employees with the pay range for their current job, upon request.
As an employee
